Art. 5 of Legislative Decree 33/2013

SIMPLE AND GENERALISED CIVIC ACCESS

Legislative Decree No. 33 of 14 March 2013 introduced, together with the obligations of publicity, transparency and dissemination of information by public administrations and similar bodies, the institution of ‘simple’ civic access, to which ‘generalised’ civic access was added by Legislative Decree 97/2016.

Access to administrative documents, information or data of the ‘Città di Rovigo’ srl nursing home can therefore take place in various ways:

Request for access to documents, i.e. the power/right of interested parties to request, view and, if necessary, obtain copies of administrative documents pursuant to Article 22 of Law 241/1990. The right of access to administrative documents is recognised to anyone who has a direct, concrete and current interest in the protection of legally relevant situations.
Request for simple civic access, i.e. the right of anyone to request documents, information and data that entities are required to publish, pursuant to Article 5, paragraph 1, of Legislative Decree 33/2013, if they have failed to make them available in the ‘Transparent Administration’ section of their institutional website.
Request for general civic access, i.e. the right of anyone to request documents and data from public bodies, pursuant to Article 5, paragraph 1, of Legislative Decree 33/2013, as amended by Legislative Decree 97/2016, in addition to those subject to mandatory publication.

Requests for simple and generalised civic access must be submitted by email to accessocivico@cittadirovigo.it. Such requests are not subject to any restrictions regarding the subjective legitimacy of the applicant and do not need to be justified.

In the event of delays or failure to publish or respond, the applicant may appeal to the substitute authority represented by the Legal Representative Mazzuccato Stefano at the certified email address: casadicura@pec.cittadirovigo.it.
